Provides for the purposes of the volunteer and exempt firemen's benevolent association of East Syracuse; changes the title of the association to include firefighters; directs the use of tax monies received to go towards furthering the purposes of such association.

AN ACT to amend chapter 746 of the laws of 1957 relating to incorporat-
ing the volunteer and exempt firemen's benevolent association of East
Syracuse, Onondaga county, New York, and providing for the powers and
duties of such corporation and for the payment to it of certain fire
insurance premium tax monies, in relation to the purposes of such
corporation and the use of certain tax monies received
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Sections 1, 3 and 7 of chapter 746 of the laws of 1957
2 relating to incorporating the volunteer and exempt firemen's benevolent
3 association of East Syracuse, Onondaga county, New York, and providing
4 for the powers and duties of such corporation and for the payment to it
5 of certain fire insurance premium tax monies, is amended to read as
6 follows:
7 Section 1. Incorporation; membership. A membership corporation by the
8 name of "Volunteer and Exempt [Firemen's] Firefighters' Benevolent Asso-
9 ciation of East Syracuse, Onondaga County, New York" is hereby created.
10 It shall be composed of such persons eligible to membership therein as
11 hereinafter provided as shall (a) notify the secretary of the East Syra-
12 cuse fire department in writing prior to the organization meeting of
13 such corporation hereinafter provided for of their desire to become
14 members, or (b) shall attend such meeting or an adjournment thereof and
15 signify their intention of becoming members at such meeting, or (c)
16 shall notify the secretary of such corporation in writing within sixty
17 days after his or her election of their desire to become members there-
18 of, and also such persons so eligible as may become members of such
19 corporation pursuant to its by-laws.
20 § 3. Purposes. The purposes of such corporation created by this act
21 shall be [the maintenance of suitable headquarters for and the promotion

1 of fraternal intercourse among members of such corporation, the relief,
2 aid and assistance of such members and their families who are disabled
3 or indigent, and the promotion of the welfare of the volunteer fire
4 service within the village of East Syracuse and the territory of the
5 East Syracuse fire district and of any village or fire district
6 contracting for fire protection with the East Syracuse fire department
7 or the board of trustees of the village of East Syracuse]: to provide
8 relief, aid and assistance to the volunteer members of such corporation
9 who are indigent, disabled or injured in the performance of their
10 duties, and their families; to maintain a suitable headquarters for the
11 members of the corporation; to promote and safeguard the welfare of the
12 volunteer members of the corporation, and their families; to provide for
13 the health and safety of the volunteer members of the corporation; and
14 to enhance the morale of the volunteer members of the corporation by
15 providing social and recreational activities for the volunteer members
16 of the corporation, and the promotion of the volunteer fire service
17 within the territory protected by such fire department of the East Syra-
18 cuse fire department.
19 § 7. Precept for payment of the fire insurance premium taxes. Such
20 corporation shall collect and there shall be paid to it all tax upon
21 premiums on policies of insurance covering property situated within the
22 village of East Syracuse and the East Syracuse fire district of the town
23 of Dewitt, Onondaga county, New York, or within any duly organized
24 territory in which the East Syracuse fire department is obligated to
25 render fire protection, imposed by section [five hundred fifty-three]
26 ninety-one hundred four of the insurance law for the use and benefit of
27 the fire department affording fire protection therein. The officer of
28 said corporation designated by its by-laws to collect and receive the
29 aforesaid tax shall have all the powers and be subject to all the
30 provisions of [section five hundred fifty-three of] the insurance law,
31 relating to treasurers of fire departments. Such corporation shall also
32 be entitled to receive a share of the tax imposed by section [five
33 hundred fifty-four] ninety-one hundred five of the insurance law, based
34 upon the business written in the territory with respect to which it is
35 entitled to collect and receive the tax under section [five hundred
36 fifty-three] ninety-one hundred four of the insurance law. Such taxes
37 shall only be used [for the care and relief of disabled or indigent
38 volunteer and exempt firemen and their families] by the corporation in
39 furtherance of its purposes as set forth in section three of this act.
40 § 2. This act shall take effect immediately; provided, however, the
41 amendments to section 7 of chapter 746 of the laws of 1957 made by
42 section one of this act shall apply to taxes due on premiums received on
43 and after January 1, 2023.
