        AN  ACT  to amend the public health law, in relation to requiring hospi-
          tals and birth centers to  prepare  and  distribute  an  informational
          leaflet  containing  information detailing how parents or guardians of
          infants and children can subscribe to the United States consumer prod-
          uct safety commission's e-mail subscription lists to receive  consumer
          product recall and safety news
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The public health law is amended by adding  a  new  section
     2  2803-s to read as follows:
     3    §  2803-s.  Access  to  product recall information.   The commissioner

     4  shall require that every hospital and birth  center  distribute  at  the
     5  time of pre-booking or admission directly to each maternity patient and,
     6  upon request, to the general public an informational leaflet. Such leaf-
     7  let shall be designed by the commissioner in conjunction with the execu-
     8  tive  director  of the state consumer protection board, on behalf of the
     9  state consumer protection board, and shall contain information detailing
    10  how parents or guardians of infants and children can  subscribe  to  the
    11  United  States  consumer product safety commission's e-mail subscription
    12  lists to receive consumer product recall and safety news by e-mail  from
    13  the  United  States  consumer  product  safety commission and such other

    14  material as deemed appropriate by the commissioner.  Such leaflet  shall
    15  be  made  available  to hospitals and birth centers by the department on
    16  its website and shall be provided in English, as well  as  the  top  six
    17  languages other than English spoken in the state according to the latest
    18  available data from the United States Bureau of Census.

     1    §  2.  This  act shall take effect on the first of May next succeeding
     2  the date on which it shall have become a law;  provided,  however,  that

     3  effective immediately, the addition, amendment and/or repeal of any rule
     4  or regulation necessary for the implementation of this act on its effec-
     5  tive  date  are  authorized and directed to be made and completed by the
     6  commissioner of health on or before such effective date.
