        Introduced  by Sen. HARCKHAM -- read twice and ordered printed, and when
          printed to be committed to the Committee on Rules
 
        AN ACT to amend the education law, in relation to notifying  parents  or
          guardians  of  their  right to refuse certain behavioral interventions
          for their children

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subparagraph 1 of paragraph b of subdivision 1 of section
     2  4402 of the education law is amended by adding a new clause (e) to  read
     3  as follows:
     4    (e) At any meeting of a committee on special education, the parents or
     5  persons  in  parental  relation to the student that are in attendance at
     6  such meeting shall be provided proper written notice of their  right  to
     7  refuse  inclusion  of  any  specific  behavioral  intervention  in  such
     8  student's individualized education plan  or  a  behavioral  intervention
     9  plan  developed  for such student pursuant to subparagraph three of this
    10  paragraph.
    11    § 2. This act shall take effect immediately.
