          printed to be committed to the Committee on Rules
 
        AN ACT to amend the  environmental  conservation  law,  in  relation  to
          providing  that one hundred percent of in-state sales of new passenger
          cars and trucks shall be zero-emissions by two thousand thirty-five

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.   Section 19-0306-b of the environmental conservation law,
     2  as added by a chapter of the laws of 2021,  amending  the  environmental
     3  conservation  law  relating  to  providing  that  one hundred percent of
     4  in-state sales of new passenger cars and trucks shall be  zero-emissions
     5  by two thousand thirty-five, as proposed in legislative bills numbers S.
     6  2758 and A. 4302, is amended to read as follows:
     7  § 19-0306-b. Zero-emissions cars and trucks.
     8    1.  It  shall  be  a goal of the state that one hundred percent of new
     9  passenger cars and trucks offered for sale or lease, or sold, or leased,
    10  for registration in the state shall be zero-emissions  by  two  thousand
    11  thirty-five.    It shall be a further goal of the state that one hundred
    12  percent of medium-duty and  heavy-duty  vehicles  offered  for  sale  or
    13  lease,  or  sold, or leased, for registration in the state be zero-emis-
    14  sions by two thousand forty-five for all operations where  feasible.  It
    15  shall  be  further  a  goal  of  the  state to transition to one hundred
    16  percent zero-emissions from new off-road  vehicles  and  equipment  [by]
    17  purchased beginning in two thousand thirty-five, where feasible.
    18    2.  The  department,  to the extent consistent with federal law, shall
    19  develop and propose:
    20    a.  Passenger  vehicle  and  truck  regulations  requiring  increasing
    21  volumes  of  new  zero-emissions  vehicles offered for sale or lease, or
    22  sold, or leased, for registration in the state towards the target of one
    23  hundred percent of in-state sales by two thousand thirty-five.
    24    b. Medium-duty and heavy-duty vehicle regulations requiring increasing
    25  volumes of new zero-emissions trucks  and  buses  offered  for  sale  or
    26  lease,  or  sold,  or leased, for registration and operated in the state

     1  towards the target of one hundred percent of the fleet transitioning  to
     2  zero-emissions vehicles by two thousand forty-five everywhere feasible.
     3    c. Strategies, in coordination with other state agencies, other states
     4  and  the federal environmental protection agency, to achieve one hundred
     5  percent zero-emissions from new off-road vehicles  and  equipment  oper-
     6  ations  in  the  state by two thousand thirty-five.  In implementing the
     7  provisions of this paragraph, the department shall act consistently with
     8  safety, technological feasibility and cost-effectiveness.
     9    3. The New York state energy research and  development  authority,  in
    10  consultation  with the department, [in consultation with] the department
    11  of economic development, [the New York state energy research and  devel-
    12  opment  authority,]  the  public  service  commission, the department of
    13  transportation, the department of motor vehicles, and other state  agen-
    14  cies, local agencies and other interested parties, shall develop a zero-
    15  emissions  vehicle  market development strategy by January thirty-first,
    16  two thousand twenty-three, and an update every three  years  thereafter,
    17  that:
    18    a. Ensures coordinated and expeditious implementation of the system of
    19  policies,  programs  and  regulations necessary to achieve the goals and
    20  orders established by this section.
    21    b. Outlines state agencies' actions to support new and used zero-emis-
    22  sions vehicle markets for broad accessibility for all residents of  this
    23  state.
    24    4.  The department, the New York state energy research and development
    25  authority, the public service commission and other state agencies, shall
    26  use existing authorities to accelerate deployment of affordable powering
    27  options for zero-emissions vehicles, in ways that serve all  communities
    28  and  particularly  low-income  and disadvantaged communities, consistent
    29  with state and federal law.
    30    5. The department, the New York state energy research and  development
    31  authority, the department of motor vehicles and the department of trans-
    32  portation,  in  consultation  with the other state agencies, shall on or
    33  before July fifteenth, two thousand  twenty-three,  identify  near  term
    34  actions and investment strategies to improve sustainable transportation,
    35  freight and transit options, including where feasible:
    36    a.  Supporting bicycle and pedestrian options, particularly in low-in-
    37  come and disadvantaged communities in the state, by  incorporating  safe
    38  and accessible infrastructure into projects where appropriate.
    39    b.  Supporting  light,  medium, and heavy-duty zero-emissions vehicles
    40  and infrastructure as part  of  larger  transportation  projects,  where
    41  appropriate.
    42    §  2.  This  act  shall  take  effect on the same date and in the same
    43  manner as a chapter of the laws  of  2021,  amending  the  environmental
    44  conservation  law  relating  to  providing  that  one hundred percent of
    45  in-state sales of new passenger cars and trucks shall be  zero-emissions
    46  by two thousand thirty-five, as proposed in legislative bills numbers S.
    47  2758 and A.  4302, takes effect.
