PARKER -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the general business law, in relation to authorizing cellular phone companies to provide notice of bills to third parties at the request of the customer The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 393-f of the general business law, as added by a 2 chapter of the laws of 2023 amending the public service law, the general 3 business law and the public authorities law relating to third-party 4 notification, as proposed in legislative bills numbers S. 406-A and A. 5 1368-A, is amended to read as follows: 6 § 393-f. Voluntary third-party notification. 1. Every telegraph or 7 telephone corporation, cable television corporation, [cellular phone8company,] or municipality shall permit a residential customer to desig- 9 nate a third party to receive notice of the total amount due or past due 10 on all bills, the amounts of any payments paid by or on behalf of such 11 residential customer, and copies of all notices relating to termination 12 of service and notices relating to collection of amounts due sent to 13 such residential customer, provided that the designated third party 14 indicates in writing a willingness to receive such notices, and provided 15 further, where a residential customer opts for third-party notifica- 16 tions, such residential customer may opt to continue to receive such 17 notices. 18 2. [Every telegraph or telephone corporation, cable television corpo-19ration, cellular phone company, or municipality shall permit a landlord,20upon written request of both the landlord and tenant, to designate a21third party to be notified of all requests for discontinuance of service22to units occupied by such tenant, provided that the designated third23party indicates in writing a willingness to receive such notices, and24provided further, where the tenant and landlord customers opt for third-25party notifications, such tenant and landlord customers may opt to26continue to receive such notices] Every cellular phone company, upon 27 request by a customer, shall permit such customer to designate a third EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. Such notice shall comply with all requirements related to the 3 protection of customer proprietary network information contained in the 4 federal communications act of 1934 (47 U.S.C. 222) and any federal regu- 5 lations adopted under that authority. 6 § 2. This act shall take effect on the same date and in the same 7 manner as a chapter of the laws of 2023 amending the public service law, 8 the general business law and the public authorities law relating to 9 third-party notification, as proposed in legislative bills numbers S. 10 406-A and A. 1368-A, takes effect.
