        Introduced  by  Sen. LAVALLE -- read twice and ordered printed, and when
          printed to be committed to the Committee on Health
 
        AN ACT in relation to certain examinations taken by funeral directors
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Notwithstanding any other law, rule, order or regulation to
     2  the contrary, a funeral director duly licensed pursuant to article 34 of
     3  the public health law at the time of application for the 2018-2020 bien-
     4  nial  renewal  registration  or  any  registration  thereafter  shall be
     5  presumed to have successfully passed all required examinations  notwith-
     6  standing  any  adverse  action  with  regard  to examination scores that
     7  occurred after the initial application for licensure had  been  approved
     8  unless the commissioner of health shall have determined, after providing
     9  the applicant due notice and an opportunity to be heard, that the appli-
    10  cant  is  in violation of paragraph (c) of subdivision 1 of section 3450
    11  of the public health law.
    12    § 2. This act shall take effect immediately.
