        Introduced  by  Sen.  CHU  --  read  twice and ordered printed, and when
          printed to be committed to the Committee on Environmental Conservation
 
        AN ACT to amend the  environmental  conservation  law,  in  relation  to
          establishing a symbol to denote environmental composting
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The  environmental  conservation  law  is  amended  by  new
     2  section 3-0323 to read as follows:
     3  § 3-0323. Composting symbol. The department shall:
     4    1.  develop  a  symbol  denoting a product that is acceptable in every
     5  composting facility governed by the department;
     6    2. create a list of categories of products that shall bear the  symbol
     7  pursuant  to  subdivision one of this section, including but not limited
     8  to single-use food containers, utensils, and wrappers,  and  compostable
     9  plastics (not biodegradable, as differentiated from compostable); and
    10    3.  promulgate rules and regulations for the implementation of, and to
    11  determine penalties for non-compliance with this section.
    12    § 2. This act shall take effect immediately.
