AN ACT to amend the education law, in relation to the disclosure of
relationships between institutions of higher education and study
abroad programs
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The education law is amended by adding a new article 25 to
2 read as follows:

5 HIGHER EDUCATION AND STUDY ABROAD
6 PROGRAMS
7 Section 1250. Definitions.
8 1251. Disclosure of relationships; higher education; study
9 abroad programs.
10 § 1250. Definitions. For purposes of this article, the following terms
11 shall have the following meanings:
12 1. "College/university" shall mean any institution of higher educa-
13 tion, recognized and approved by the regents of the university of the
14 state of New York, which provides a course of study leading to the
15 granting of a post-secondary degree or diploma.
16 2. "Study abroad programs" shall mean programs which are coordinated
17 by colleges/universities in the state of New York and private organiza-
18 tions, that provide students with the opportunity to work or study,
19 wholly or in principal part, outside of the United States of America.
20 3. "Perquisite" shall mean any expenses paid by a study abroad
21 program to any employee or representative of a college or university for
22 travel, lodging, food or entertainment. The term "perquisite" shall also

1 mean any direct financial benefit realized by a college/university as a
2 result of its students attending a particular study abroad program.
3 § 1251. Disclosure of relationships; higher education; study abroad
4 programs. 1. Each college/university located in this state shall
5 disclose any perquisites that it receives from all study abroad programs
6 that its students participate in. Such disclosure shall be made in writ-
7 ing to anyone who requests it.
8 2. In instances where a student pays the usual costs of attending a
9 particular college/university for a semester, and such
10 college/university in turn pays for such student's participation in a
11 particular study abroad program, such college/university shall disclose
12 the actual costs of the study abroad program paid by such
13 college/university in writing to anyone who requests it.
14 § 2. This act shall take effect on the one hundred twentieth day after
15 it shall have become a law.
