AN ACT to amend the social services law, in relation to making care and
services provided by licensed mental health counselors and marriage
and family therapists eligible for coverage under the Medicaid program
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph (gg) of subdivision 2 of section 365-a of the
2 social services law, as added by a chapter of the laws of 2021 amending
3 the social services law relating to making care and services provided by
4 licensed mental health practitioners eligible for coverage under the
5 Medicaid program, as proposed in legislative bills numbers S. 6575 and
6 A. 6323, is amended to read as follows:
7 (gg) care and services provided by mental health [practitioners] coun-
8 selors and marriage and family therapists licensed pursuant to article
9 one hundred sixty-three of the education law acting within their scope
10 of practice, where such services would otherwise be covered under this
11 title. Nothing in this paragraph shall be construed to modify or expand
12 the scope of practice of a mental health counselor[,] or marriage and
13 family therapist[, creative arts therapist or psychoanalyst] licensed
14 pursuant to article one hundred sixty-three of the education law.
15 § 2. This act shall take effect on the same date and in the same
16 manner as a chapter of the laws of 2021 amending the social services law
17 relating to making care and services provided by licensed mental health
18 practitioners eligible for coverage under the Medicaid program, as
19 proposed in legislative bills numbers S. 6575 and A. 6323, takes effect.
