“Today, I am proud to announce that I have joined a bi-partisan Assembly coalition urging the Governor to swiftly sign and implement Assembly Bill A.1838-C, common sense legislation which would expand retail sales of pepper spray and other self-defense spray devices to general retail outlets across New York State.

“Self-defense spray devices, such as pepper spray, have proven themselves a powerful, non-lethal, and lifesaving tool for individuals to defend themselves from their would-be attackers and to escape from dangerous and life-threatening situations. And while pepper spray and similar products are legal to purchase and possess in New York State, the retail sale of these devices under current law is strictly limited to only licensed firearm dealers and licensed pharmacists, resulting in an unnecessary barrier of access that could prevent the public from lawfully defending themselves in an emergency.

“Unanimously passing both the Assembly and the Senate, A.1838-C removes this restrictive sales requirement, allowing general retail outlets to offer self-defense sprays to the public and for the broader distribution and sale of these devices statewide, while maintaining key safety guardrails already in place, including the prohibition of sales to minors under 18, prohibiting possession to individuals convicted of a violent crime or felony, and clear self-defense use of force standards.

“This legislation is a win for public safety, and a win for women and all vulnerable people who deserve to feel secure in their daily lives. I urge Governor Hochul to sign A.1838-C into law without delay, so that every New Yorker has the enhanced ability to protect themselves and their loved ones."
