Smullen: Eliminating Limitation on Supreme Court Justices is Unconstitutional

A Statement from Assemblyman Robert Smullen (R,C-Mohawk Valley and the Adirondacks) in response to proposal A.5366/S.5414, which would eliminate the current constitutional limitation on the number of Supreme Court justices.

“I am strongly opposed to this proposal, which would remove the current constitutional limitation on the number of Supreme Court justices and also allow the Legislature to set the number of justices as they see fit throughout courts statewide. This proposed change to the State Constitution violates the U.S. Constitution and could create a state judiciary system that is disproportionate to our rural communities. It is in the best interest of New Yorkers looking to be represented and heard in a fair and consistent manner that this proposal does not move forward.”
