MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)
 
BILL NUMBER: A1500
 
SPONSOR: Pheffer Amato
  SUMMARY OF PROVISIONS: Amends relevant section of the Civil Practice Law and Rules relating to the personal property exempt from application to the satisfaction of money judgements.   EXISTING LAW: Currently/ a 9/11 victim would have to file for bankruptcy to have his/her VCF award be exempt as "property that is traceable to an award under a crime victim's reparation law". There is no protection for a 9/11 victim without filing a bankruptcy.   JUSTIFICATION: This bill seeks to continue to protect our 9/11 Victims by safeguarding their crime victim's reparation from being used to satisfy money judge- ments.   EFFECTIVE DATE: Immediately.

        AN ACT to amend the civil practice law and rules, in relation to provid-
          ing an exemption of any  award  from  the  September  eleventh  victim
          compensation  fund from application to the satisfaction of money judg-
          ments

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 5205 of the civil practice law and rules is amended
     2  by adding a new subdivision (q) is added to read as follows:
     3    (q)  Exemption  of  the recovery of awards from the September eleventh
     4  victim compensation fund of two thousand  one  established  pursuant  to
     5  title  IV of the federal air transportation safety and system stabiliza-
     6  tion act, public law 107-42, as amended.
     7    § 2. This act shall take effect immediately.
