PURPOSE OR GENERAL IDEA OF BILL:
To ensure gun buybacks meet. the intended goal of taking firearms off
our streets.
 
SUMMARY OF PROVISIONS:
Section 1 amends Section 233 of the executive law by adding a new subdi-
vision 6 defining gun buybacks as the voluntary relinquishment of a
firearm, rifle or shotgun for disposal that renders such weapon inopera-
ble, and all components thereof unable to be incorporated in an operable
firearm, rifle or shotgun. It further adds that no firearm, rifle or
shotgun manufactured for the purpose of remuneration is eligible.
Section 2 sets the effective date.

JUSTIFICATION:
The purpose of gun buybacks is to take firearms off the streets perma-
nently. However, some companies that "dispose" of surrendered firearms
only make a nominal alteration that renders that particular firearm
inoperable, and then sell most of the parts for reuse in other, operable
firearms. In addition, the advent of 3D printers capable of printing
firearms has prompted some people to utilize the technology to produce
new firearms for the sole purpose of remuneration. In one instance,
someone received $21,000 in remuneration for 3D printed firearms.
This bill amends the executive law, which currently has no specific
definition for a gun buyback, to define gun buybacks as remuneration of
firearms that are disposed of such that no part remains operable. It
adds that no firearm manufactured for the purpose of remuneration is
eligible. This ensures gun buybacks achieve their intended goal of
taking firearms off our streets.

AN ACT to amend the executive law, in relation to municipal gun buyback

The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 233 of the executive law is amended by adding a new
2 subdivision 6 to read as follows:
3 6. For the purposes of this section, "gun buyback" shall mean remuner-
4 ation for the voluntary relinquishment of a firearm, rifle or shotgun
5 for disposal that renders such weapon inoperable, and all components
6 thereof unable to be incorporated in an operable firearm, rifle or shot-
7 gun. No firearm, rifle or shotgun shall be eligible for surrender and
8 remuneration if it was manufactured for the purpose of receiving a mone-
9 tary reward under a gun buyback program.
10 § 2. This act shall take effect immediately.
