TITLE OF BILL:
An act to amend the public health law, in relation to including Suvorex-
ant in the Schedule IV list of depressant drugs
 
PURPOSE::
To add Suvorexant to the NYS list' of Schedule IV controlled substances
to align with the federal regulations.
 
SUMMARY OF PROVISIONS::
Section 1 amends subsection (c) of schedule IV of section 3306 of the 2
public health law by adding a new paragraph 54
Section 2 establishes the effective date.
 
JUSTIFICATION:
Suvorexant is a pharmaceutical that is Food and Drug Administration
(FDA) approved and a Drug Enforcement Agency ,(DEA) scheduled controlled
substance that is not included in the New York State Prescription Moni-
toring Program (PMP). This legislation would add Suvorexant to the PMP
which is an important tool for practitioners when prescribing Schedule
II, III, and IV controlled substances. The PMP Registry provides practi-
tioners with direct, secure access to view dispensed controlled
substance prescription histories for their patients.

AN ACT to amend the public health law, in relation to including Suvorex-
ant in the Schedule IV list of depressant drugs
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision (c) of schedule IV of section 3306 of the
2 public health law is amended by adding a new paragraph 54 to read as
3 follows:
4 (54) Suvorexant.
5 § 2. This act shall take effect on the ninetieth day after it shall
6 have become a law.
