  TITLE OF BILL: An act to amend the penal law, in relation to establishing the crime of theft of an impounded vehicle   PURPOSE OR GENERAL IDEA OF BILL: To establish the crime of theft of an impounded vehicle   SUMMARY OF PROVISIONS: Section 1 Amends the penal law to include theft of an impounded vehicle and includes the penalty Section 2 sets forth the effective date which is immediately.   JUSTIFICATION: Currently, there is no enforcement for theft of services for leaving with an impounded vehicle without payment, and the tow truck company does not have legal recourse for a vehicle removed off of their lot without paying for the towing services. Therefore, the tow truck compa- nies are losing out on income due to them for services rendered. Towing services are often ordered by municipalities,law enforcement, or private parties to tow a vehicle in violation of a law or parking restrictions and the tow company performs the work with the understanding they collect their fees from the vehicle owner when the vehicle is retrieved. Owners have removed their vehicles utilizing an additional key and ulti- mately leaving with a vehicle and not paying for the service performed. This bill seeks to fix that issue.   PRIOR LEGISLATIVE HISTORY: 2023 - referred to codes 2024 - referred to codes   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None.   EFFECTIVE DATE: This act shall take effect immediately.

        AN ACT to amend the penal law, in relation to establishing the crime  of
          theft of an impounded vehicle
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The penal law is amended by adding a new section 165.14  to
     2  read as follows:
     3  § 165.14 Theft of an impounded vehicle.
     4    A  person  is  guilty  of theft of an impounded vehicle if such person
     5  removes an impounded vehicle without paying any necessary fees prior  to
     6  such removal.
     7    Theft of an impounded vehicle is a class A misdemeanor.
     8    § 2. This act shall take effect immediately.
