TITLE OF BILL:
An act to amend the public officers law, in relation to permitting
assistant district attorneys to live anywhere within the state
 
PURPOSE OR GENERAL IDEA OF BILL:
Permits assistant district attorneys to live anywhere within the state
 
SUMMARY OF PROVISIONS:
Section one: Section 3 of the public officers law is amended by adding a
2 new subdivision 2-e
Section two: Establishes the effective date.
 
JUSTIFICATION:
District attorneys' offices across the state have been struggling with
significant turnover during the past several years. This issue is
compounded by the fact that offices are often prevented from hiring
assistant district attorneys from outside their areas of jurisdiction.
This requirement significantly limits the hiring prospects for offices
that are already suffering from staffing shortages. This bill will elim-
inate the requirement for assistant district attorneys to reside within
the jurisdiction of their office in order to increase the potential
hiring pool for struggling district attorneys' offices.

AN ACT to amend the public officers law, in relation to permitting
assistant district attorneys to live anywhere within the state
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 3 of the public officers law is amended by adding a
2 new subdivision 2-e to read as follows:
3 2-e. The provisions of this section requiring a person to be a resi-
4 dent of the political subdivision or municipal corporation of the state
5 for which they shall be chosen or within which their official functions
6 are required to be exercised, shall not prevent a person from holding
7 the office of assistant district attorney in any county.
8 § 2. This act shall take effect immediately.
