  TITLE OF BILL: An act to amend the cannabis law, in relation to requiring applicants for a license to cultivate, process, distribute, deliver, or dispense cannabis within the state to pay a prevailing wage or have entered into a project labor agreement for the construction of buildings or transpor- tation of items relating to the activity described in the application   PURPOSE OR GENERAL IDEA OF BILL: Requires applicants for a cannabis license to pay a prevailing wage or have entered into a project labor agreement for the construction of buildings or transportation.   SUMMARY OF PROVISIONS: Section 1- paragraphs (1) and (m) of subdivision 1 of section 64 of the cannabis laws are amended and a new paragraph (n) is added (I) the applicant satisfies any other conditions as determined by the board; and (m) if the applicant is a registered organization, the organization's maintenance of effort in manufacturing and/or dispensing and/or research of medical cannabis for certified patients and caregivers and (n) the applicant will pay a prevailing wage or has entered into a project labor agreement for the construction of any buildings which will be used to properly carry on the activity described in the application and for transportation to and from the grower to the applicant or to and from the manufacturer to the retail licensee. Section 2 - Effective date.   JUSTIFICATION: New York state's new cannabis law will provide for new business opportu- nities with the construction of new buildings and the transportation of goods from cultivation to dispensing. Both prevailing wage requirements and projects labor agreements ensure workers earn fair wages in a safe working environment while employers' benefit from greater productivity and cost savings. This bill will ensure that prevailing wage and labor agreements are met to ensure workers in NYS cannabis businesses are protected.   PRIOR LEGISLATIVE HISTORY: 2022 A.8093 - referred to codes   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None.   EFFECTIVE DATE: This act shall take effect immediately.

        AN  ACT  to  amend the cannabis law, in relation to requiring applicants
          for a license to cultivate, process, distribute, deliver, or  dispense
          cannabis  within  the  state  to pay a prevailing wage or have entered
          into a project labor agreement for the construction  of  buildings  or
          transportation  of  items  relating  to  the activity described in the
          application
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.   Paragraphs (m) and (n) of subdivision 1 of section 64 of
     2  the cannabis law, paragraph (m) as amended and paragraph (n) as added by
     3  section 15 of part UU of chapter 56 of the laws of 2023, are amended and
     4  a new paragraph (o) is added to read as follows:
     5    (m) if the applicant is a registered organization, the  organization's
     6  maintenance of effort in manufacturing and/or dispensing and/or research
     7  of medical cannabis for certified patients and caregivers; [and]
     8    (n)  whether the applicant or its managing officers have been found to
     9  have engaged in activities in violation of this chapter[.]; and
    10    (o) the applicant will pay a prevailing wage or  has  entered  into  a
    11  project labor agreement for the construction of any buildings which will
    12  be  used  to properly carry on the activity described in the application
    13  and for transportation to and from the grower to the applicant or to and
    14  from the manufacturer to the retail licensee.
    15    § 2. This act shall take effect immediately.
