An act to amend the vehicle and traffic law, in relation to the length
of time that a person on a visa can hold a driver's license, learner's
permit or non-driver identification card
PURPOSE OR GENERAL IDEA OF BILL:
The purpose of this bill is to prevent the use of driver's license,
learner's permits, and non-driver identification cards issued to aliens
by the Department of Motor Vehicles beyond the aliens visas' expiration
date.
SUMMARY OF SPECIFIC PROVISIONS:
Amends subdivision 1 of section 503 of the vehicle and traffic law by
adding a new paragraph (c); amends section 491 of the vehicle and traf-
fic law by adding a new subdivision 1-a.
JUSTIFICATION:
To restrict aliens from using driver's licenses, learner's permits and
non driver identification cards issued by the Department of Motor Vehi-
cles beyond the expiration date of said alien's visa.

EFFECTIVE DATE:
This act shall take effect on the ninetieth day after it shall have

implementation of this act on its effective date are authorized and
directed to be made and completed on or before such effective date.

AN ACT to amend the vehicle and traffic law, in relation to the length
of time that a person on a visa can hold a driver's license, learner's
permit or non-driver identification card
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 1 of section 503 of the vehicle and traffic law
2 is amended by adding a new paragraph (c) to read as follows:
3 (c) Whenever a driver's license or learner's permit issued pursuant to
4 this article, or a privilege of operating a motor vehicle or of obtain-
5 ing such a license or permit has been issued to a noncitizen who has
6 been issued a visa, such driver's license or learner's permit shall
7 expire upon the expiration of the visa or upon the date the driver's
8 license or learner's permit would otherwise expire under this chapter,
9 whichever date first occurs. If the driver's license or learner's
10 permit of a noncitizen with a visa expires before the noncitizen's visa
11 expires then the noncitizen can renew such license or permit upon show-
12 ing the department proof of a valid visa.
13 § 2. Section 491 of the vehicle and traffic law is amended by adding a
14 new subdivision 1-a to read as follows:
15 1-a. Period of validity; visa. Whenever an identification card issued
16 by the department has been issued to a noncitizen who has been issued a
17 visa, such identification card shall expire upon the expiration of the
18 visa or upon the date the identification card would otherwise expire
19 under this chapter, whichever date first occurs. If the identification
20 card of a noncitizen with a visa expires before the noncitizen's visa
21 expires then the noncitizen can renew such identification card upon
22 showing the department proof of a valid visa.
23 § 3. This act shall take effect on the ninetieth day after it shall
24 have become a law. Effective immediately, the addition, amendment
25 and/or repeal of any rule or regulation necessary for the implementation
26 of this act on its effective date are authorized to be made and
27 completed on or before such effective date.
