TITLE OF BILL:
An act to amend the executive law, in relation to requiring electric
vehicle charging stations and electric vehicle ready parking spaces in
certain state properties
 
PURPOSE OR GENERAL IDEA OF BILL:
Requires electric vehicle charging stations and electric vehicle ready
parking spaces in certain new constructions and on state properties.
 
SUMMARY OF PROVISIONS:
Section 1: The executive law is, amended by adding a new section 201-b:
Electric vehicle charging stations. Any parking facility owned and oper-
ated by the state of New York, that offers between fifty and two hundred
parking spaces for the purpose of public use, state employee use and
pay-per-usage, is required to install electric charging stations in at
least ten percent of the total number of parking spaces offered by such
facility.
Any parking facility owned and operated by the state of New York, that
offers more than two hundred parking spaces for the purpose of public
use, state employee use and pay-per-usage, is required to install elec-
tric charging stations in at least twenty percent of the total number of
parking spaces offered by such facility. Each charging station shall
support electric vehicle charging with a minimum of forty amperes and
two hundred eight volts of electrical capacity.
The office of general services shall be responsible for the installation
of any supply equipment and charging stations. If such installation
requires the state to upgrade any electrical supply equipment the office
of general services shall increase the electrical capacity of the exist-
ing equipment. If the office of general services is unable to make such
technical upgrades, the office may contract with a service provider to
do the upgrade. The office of general services shall be responsible for
maintenance of the equipment and charging stations. The office may
contract with a service provider to do the necessary work if needed.
Section 2: Section 378 of the executive law is amended by adding a new
subdivision 17-a. a. Standards to require new construction that includes
dedicated off street parking to have:
(i)Electric vehicle charging stations; and (ii) Electric vehicle ready
parking spaces.
b. for the purposes of this sub-division: defines
(i) "electric vehicle ready paring space"
(ii) "level 2 electric vehicle charging station" (iii)"New construction"
(iv)"mixed-use building"
(v)"electric vehicle energy management system" (vii) "automobile parking
lift"
c. Standards shall require that the number of electric vehicle charging
stations, and electric vehicle ready parking spaces shall be as follows:
(i) a one, two or three family home equipped with a garage, driveway or
parking lot, or other off street parking, shall have at least one elec-
tric vehicle ready parking space at not less than 20 ampere for each
dwelling unit up to the total number of parking spaces.
(ii) a multi-unit residential building with off street parking shall
have one hundred percent of available parking spaces be at least elec-
tric vehicle ready parking spaces not less than 20 ampere, which shall
include at least twenty percent of available parking spaces equipped
with level 2 electric vehicle charging stations at not less than 20
ampere. For two adjacent electric vehicle ready parking spaces or level
2 electric vehicle charging stations, a single branch circuit of not
less than 40 ampere shall be permitted. For buildings with individually
metered residential units and parking spaces specifically designated for
the use of individual units, electric vehicle ready parking spaces and
level 2 electric vehicle charging stations installed in such parking
spaces shall be wired to the individual unit's electric meter, unless
deemed unfeasible.
(iii) a commercial building with between one and ten parking spaces
shall have at least one available parking space be an electric vehicle
ready parking space at not less than 40 ampere or equipped with a level
2 electric vehicle charging station at not less than 40 ampere or direct
current fast charging station.
(iv) a commercial building with eleven or more parking spaces shall have
at least twenty percent of available parking spaces be at least electric
vehicle ready parking spaces not less than 40 ampere which shall include
at least ten percent of available parking spaces equipped with level 2
electric vehicle charging stations not less than 40 ampere or direct
current fast charging stations. For every additional electric vehicle
ready parking space or level 2 electric vehicle charging station beyond
the number required, 2 electric vehicle ready parking spaces or level 2
electric vehicle charging stations required may be served by a single
branch circuit of not less than 40 ampere.
(vi) for a building that includes an automobile parking lift, the number
of parking spaces used to determine the n umber of required electric
vehicle ready parking space or level 2 electric vehicle charging
stations shall equal the total number of parking spaces minus the number
of elevated parking spaces contained in the automobile parking lift.
D. Requirements for installation of electric vehicle charging stations
and electric vehicle ready parking spaces under this subdivision may be
met by installing multiple electric vehicle charging stations or elec-
tric vehicle ready parking spaces on a single branch circuit, when used
in conjunction with an electric vehicle energy management system to
control charging station loads.
e. the owner of a building may apply to the local department of build-
ings or similar entity for a *waiver of the requirements of this subdi-
vision, which such local department of buildings or similar entity may
grant if such owner can demonstrate that the provisions present an undue
hardship due, or that the geographic location would result in a signif-
icant burden on the owner.
f. the requirements of this subdivision shall not apply to one hundred
percent affordable housing.
g. standards pursuant to this subdivision shall include requirements for
clear and prominent signage denoting the availability and location of
electric vehicle ready parking spaces and electric vehicle charging
stations.
h. nothing in this subdivision shall be interpreted or otherwise
construed as pre-empting a municipality from adopting standards, codes,
rules, or regulations that are stricter than those contained in this
subdivision.
Section: Identifies effective date.
 
JUSTIFICATION:
S&P Global Mobility registration data shows that as of October 31, 2022
there were 1.9 million electric vehicles (EVs) in operation, or 0.7% of
the 281 million. Given the escalating number of EV companies forecast to
launch within the next ten years, the market is poised for rapid growth.
According to an analysis from McKinsey & Company by 2025 there could be
as many as 7.8 million electric vehicles in operation in the United
States. To support that number of vehicles they expect there will need
to be about 700,000 Level 2 and 70,000 Level 3 chargers in operation. By
2027, those numbers will have risen to about 1.2 million Level 2 char-
gers and 109,000 Level 3 chargers. In a recent report from RMI they
noted that Electric vehicles will account for 62% to 86% of global sales
by 2030, this will increase the number chargers needed to an even higher
level. The U.S. Department of Energy's National Renewable Energy Labo-
ratory estimates the country will need 28 million charging ports to
refuel the 33 million light-duty electrics that could be on the road by
then. Publicly accessible fast charging ports along highway corridors
and in local communities; and 1 million publicly accessible Level 2
charging ports located near homes and workplaces, including in high-den-
sity neighborhoods and at office buildings and retail outlets.
A poll conducted by the Energy Policy Institute at the University of
Chicago and the Associated Press-NORC Center for Public Affairs Research
found that 47% of U.S. adults said it's not likely they would buy an EV
as their next car, with nearly 80% saying that a lack of charging
stations was a factor. This needs to change given that by 2035 in New
York State, the law requires all new passenger cars and trucks sold in
the state to be all-electric, or zero emission. This bill will contrib-
ute to the number of EV charging stations needed by requiring there be
electric vehicle charging stations and electric vehicle ready parking
spaces in certain new constructions and on state properties. This in
turn will boost consumer confidence when purchasing a new EV vehicle.

EFFECTIVE DATE:
This act shall take effect on the first of April next succeeding the
date on which it shall have become a law. Effective, immediately, the
addition, amendment and/or repeal of any rule or regulation necessary
for the implementation of this act on its effective date are authorized
to be made and completed on or before such effective date.

AN ACT to amend the executive law, in relation to requiring electric
vehicle charging stations and electric vehicle ready parking spaces in
certain state properties
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The executive law is amended by adding a new section 201-b
2 to read as follows:
3 § 201-b. Electric vehicle charging stations. 1. For the purposes of
4 this section, the term "parking facility" shall mean a parking garage,
5 parking structure, or open parking lot that is paved and striped to
6 designate individual parking spaces for vehicles and which has fifty
7 parking spaces or more.
8 2. Any parking facility owned and operated by the state of New York,
9 that offers between fifty and two hundred parking spaces for the
10 purposes of public use, state employee use and pay-per-usage, is hereby
11 required to install electric charging stations in at least ten percent
12 of the total number of parking spaces offered by such facility.
13 3. Any parking facility owned and operated by the state of New York,
14 that offers more than two hundred parking spaces for the purposes of
15 public use, state employee use and pay-per-usage, is hereby required to
16 install electric charging stations in at least twenty percent of the
17 total number of parking spaces offered by such facility.
18 4. Each electric vehicle charging station required pursuant to this
19 section shall support electric vehicle charging with a minimum of forty
20 amperes and two hundred eight volts of electrical capacity. Such elec-
21 tric vehicle charging stations and all other components and work appur-
22 tenant thereto shall be in accordance with all applicable state, county,
23 city, town, or village electrical codes.

1 5. The office of general services shall be responsible for the instal-
2 lation of any electric vehicle supply equipment and charging stations.
3 If such installation shall require the state to make upgrades to any
4 electrical supply equipment to safely and sufficiently power and operate
5 such charging stations, the office of general services shall increase
6 the electrical capacity of the existing system by installing new compo-
7 nents as necessary. If the office of general services is unable to make
8 such technical upgrades to a facility, the office may contract with a
9 licensed electrician or similar service provider to upgrade the elec-
10 trical capacity of said facility. Such contracted work shall comply with
11 the provisions of article eight of the labor law, including the payment
12 of a wage of not less than the prevailing wage in the locality where
13 such parking facility is located.
14 6. The office of general services shall be responsible for the mainte-
15 nance, general upkeep and repair of any electric vehicle supply equip-
16 ment and charging stations. If the office of general services is unable
17 to complete such maintenance or repairs, the office may contract with a
18 licensed electrician or similar repair service to complete the necessary
19 work on said equipment.
20 § 2. This act shall take effect on the first of April next succeeding
21 the date on which it shall have become a law. Effective immediately, the
22 addition, amendment and/or repeal of any rule or regulation necessary
23 for the implementation of this act on its effective date are authorized
24 to be made and completed on or before such effective date.
