NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A8970

SPONSOR: Yeger
TITLE OF BILL: An act to amend the election law, in relation to the timing for a candi- date to decline a nomination   PURPOSE: Establishes a later deadline for the declination of a nomination by a candidate who was unsuccessful in a primary but still has one or more other ballot lines in the general election; and clarifies that the addi- tional circumstances by which a candidate may decline nominations also applies to local offices.   SUMMARY OF SPECIFIC PROVISIONS: § 1: Extends the deadline for the declination of a nomination by a candidate who was unsuccessful in a primary but still has one or more other ballot lines in the general election until the statutory deadline for the certification of ballot by the Board of Elections. § 2: Effective date.   JUSTIFICATION: Following a primary election there is a very brief window and limited circumstances in which an unsuccessful candidate may decline any other ballot lines on which the candidate's name would appear in the general election. In many cases the deadline can be before the results of the primary are certified by the Board of Elections. Thus, candidates who might not wish to continue running in November have to make an unneces- sarily early decision by when to decline the remaining lines. This might have made sense when primaries occurred in September, but is no longer necessary now that primaries occur in June. This later deadline to be established by this Act would allow candidates to make these determi- nations after the primary results have been certified.   PRIOR LEGISLATIVE HISTORY: None.   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect immediately.
