  TITLE OF BILL: An act to amend the public officers law, in relation to removing public officials for executing warrants from the international criminal court   PURPOSE OR GENERAL IDEA OF BILL: To allow for the removal of public officials from office for executing international criminal court warrants until such time as any related treaty is ratified by the United States   SUMMARY OF PROVISIONS: Section 1: Adds a new section 35-b to the public officers law to allow for the removal of a public officer who executes a warrant issued by the international criminal court in violation of federal law unless the United States shall become a party to any.such treaty recognizing the ICC. Section 2: Includes the effective date.   JUSTIFICATION: Despite assurances to the contrary, local officials serving in New York State do not have the authority to enforce/execute warrants issued by the international criminal court. Localities in New York State are only subjected to the laws of the United States, New York State, and any laws passed by the localities themselves. The U.S. constitution gives the President, with at least two-thirds of United States. Senators consenting, the power to make treaties. The treaty that would make the US a party to the Rome Statute was never ratified, meaning'any local official executing/enforcing an interna- tional warrant from the ICC is breaking federal law prohibiting such activities and, by extension, their oath of office to uphold the Consti- tution and laws of the United States. This bill reaffirms New York's commitment to operating within the bounds of the law and provides for the removal of any public official who executes a warrant issued by the International Criminal Court until such time as the necessary treaty is ratified.   PRIOR LEGISLATIVE HISTORY: New Bill   EFFECTIVE DATE: Immediately.

        AN  ACT to amend the public officers law, in relation to removing public
          officials for executing warrants from the international criminal court
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1. The public officers law is amended by adding a new section
     2  35-b to read as follows:
     3    § 35-b. Removal for unlawful execution of international criminal court
     4  warrant. A person holding any public office shall  be  removable  there-
     5  from,  in  the  manner provided by law, for the execution of an interna-
     6  tional criminal court arrest warrant in violation of federal  law  until
     7  such  time  as  the  United  States ratifies any necessary international
     8  treaty that would recognize the jurisdiction and authority of the inter-
     9  national criminal court.
