TITLE OF BILL:
An act to amend the education law, in relation to including a represen-
tative of the drug or medical device manufacturer industry on the state
board of pharmacy
 
PURPOSE:
To expand the membership of the state board of pharmacy to include a
representative of the drug or medical device manufacturer industry.
 
SUMMARY OF PROVISIONS:
Section 1 amends section 6804 of the education law to modify the compo-
sition of the state board of pharmacy by adding one member who is a
representative of either drug manufacturers or medical device manufac-
turers. The amendment adjusts the board's membership structure while
maintaining existing requirements for pharmacist and registered pharmacy
technician representation.
Section 2 provides that the act shall take effect on the sixtieth day
after it shall have become a law.
 
JUSTIFICATION:
The amended language of this bill broadens the professional expertise
represented on the state board of pharmacy by including a representative
from the drug or medical device manufacturer industry. This addition is
intended to enhance the board's ability to advise the regents and the
department on matters of professional licensing, regulation, and indus-
try practices by incorporating perspectives from manufacturers directly
involved in the development and production of pharmaceuticals and
medical devices.

AN ACT to amend the education law, in relation to including a represen-
tative of the drug or medical device manufacturer industry on the
state board of pharmacy
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The opening paragraph of section 6804 of the education
2 law, as amended by chapter 414 of the laws of 2019, is amended to read
3 as follows:
4 A state board of pharmacy shall be appointed by the regents on recom-
5 mendation of the commissioner for the purpose of assisting the regents
6 and the department on matters of professional licensing and professional
7 conduct in accordance with section sixty-five hundred eight of this
8 title. The board shall be composed of not less than ten members, nine of
9 whom shall be pharmacists licensed in this state for at least five
10 years, one of whom shall be a representative of either drug or medical
11 device manufacturers and two registered pharmacy technicians. The
12 initial registered pharmacy technician members of the state board of
13 pharmacy need not be licensed prior to their appointment but shall have
14 met all other requirements of licensure pursuant to section sixty-eight
15 hundred forty-two of this title except for filing an application and
16 paying a fee. An executive secretary to the board shall be appointed by
17 the regents on recommendation of the commissioner and shall be a pharma-
18 cist licensed in this state for at least five years. The board shall
19 provide assistance to the department:
