TITLE OF BILL:
An act to amend the executive law, in relation to requiring standards
for the new construction of electric vehicle charging stations to
require such stations to have an external cutoff switch
 
PURPOSE OR GENERAL IDEA OF BILL::
This bill seeks to make it easier and quicker to cut off all power from
a charging station to an electric vehicle to prevent overheating and
fires.
 
SUMMARY OF PROVISIONS::
Section 1: Requires new construction of electric vehicle charging
stations to include an external automatic cutoff switch; includes bicy-
cles with electric assist and electric scooters; defines an automatic
cutoff switch.
Section 2: Sets effective date.
 
JUSTIFICATION:
There has been significant news coverage in recent years regarding fires
that were started due to an e-bike, electric scooter, or electric vehi-
cle overheating during the charging process. Most of these vehicles use
lithium-ion batteries, which are prone to overheating due to their
density.
An external automatic cutoff switch will make it easier for users to
immediately cut off all power to the vehicle if they realize overheating
is occurring. This has the potential to reduce the number of damaging
and deadly fires that were started due to electric vehicle charging.
This bill will apply only to the construction of new charging stations.

AN ACT to amend the executive law, in relation to requiring standards
for the new construction of electric vehicle charging stations to
require such stations to have an external cutoff switch
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 20 of section 378 of the executive law, as
2 renumbered by section 3 of part RR of chapter 56 of the laws of 2023, is
3 renumbered subdivision 21 and a new subdivision 20 is added to read as
4 follows:
5 20. Standards requiring new construction of permanently installed
6 residential electric vehicle charging stations to include an external
7 cutoff switch. Such requirements shall also apply to the sale or trans-
8 fer of a residence containing a permanently installed electric vehicle
9 charging station. A cutoff switch shall be a hand-operated switch which
10 is capable of cutting off all power and electricity to the vehicle with-
11 out the need of a key or to unlock the device. For permanently
12 installed residential electric vehicle charging stations, such cutoff
13 switch shall be placed outside of the house or garage.
14 § 2. This act shall take effect immediately.
