AN ACT to amend the environmental conservation law, in relation to
instituting a moratorium on the distribution, sale or use of glypho-
sate until a task force completes a study regarding the safety, alter-
natives and use of such compound
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The environmental conservation law is amended by adding a
2 new section 37-0123 to read as follows:
3 § 37-0123. Prohibition against use of glyphosate.
4 1. No person, firm, partnership, association, limited liability compa-
5 ny or corporation shall distribute, sell, offer for sale or use glypho-
6 sate or any products containing glyphosate within New York state until
7 July first, two thousand twenty-eight.
8 2. For the purpose of this section, "glyphosate" shall mean a synthet-
9 ic compound that is a non-selective systemic herbicide, also known as
10 N-(phosphonomethyl) glycine with a chemical formula of C3H8NO5P.
11 3. There shall be established within the department a glyphosate task
12 force which shall consist of the following members:
13 (a) The commissioner of the department, or the commissioner's desig-
14 nee.
15 (b) The commissioner of the department of health, or such commission-
16 er's designee.
17 (c) The commissioner of the department of agriculture and markets, or
18 such commissioner's designee.
19 (d) A representative from the state university of New York's college
20 of environmental science and forestry, appointed by the governor.
21 (e) A representative from the New York farm bureau, appointed by the
22 governor.
EXPLANATION--Matter in italics (underscored) is new; matter in brackets

1 (f) A representative from the pesticide industry, appointed by the
2 governor.
3 (g) A representative from an environmental organization, appointed by
4 the governor.
5 4. The task force shall:
6 (a) Research and identify any health and safety concerns associated
7 with the use of glyphosate.
8 (b) Identify safe alternatives to glyphosate.
9 (c) Determine whether the use of glyphosate should be permitted in the
10 state.
11 (d) If the use of glyphosate should be permitted, identify recommended
12 safe practices associated with the use of glyphosate.
13 5. The members of the task force shall serve without compensation,
14 except members shall be allowed their necessary and actual expenses
15 incurred in the performance of their duties under this section.
16 6. The members of the task force shall submit a report of their find-
17 ings and recommendations, including any proposed legislation, to the
18 governor and legislature no later than January first, two thousand twen-
19 ty-eight.
20 7. The glyphosate task force shall cease to exist on June thirtieth,
21 two thousand twenty-eight.
22 § 2. This act shall take effect immediately.
