NEW YORK STATE ASSEMBLY MEMORANDUM IN SUPPORT OF LEGISLATION submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A6238
SPONSOR: Carroll R

TITLE OF BILL:
An act to amend the alcoholic beverage control law and the administra-
tive code of the city of New York, in relation to permitting the
possession and consumption of alcoholic beverages in certain public
places

PURPOSE OR GENERAL IDEA OF BILL:
To make it lawful for a person to possess an open container of alcohol
and consume alcohol in certain public places.

SUMMARY OF PROVISIONS:
Section 1 defines the term "public space" within the context of this
bill and makes it lawful for a person to possess and drink from an open
container of alcohol in such public spaces. Public spaces for the
purposes of this bill are limited to parks, beaches boardwalks, and
streets closed to vehicular traffic for outdoor dining or recreational
activity.
Section 2 amends section 10-125 of the administrative code of the city
of New York.
Section 3 sets an effective date.

JUSTIFICATION:
In many places throughout the world, open consumption of alcohol is
permitted. In New York the police and others turn a blind eye if the
imbiber is drinking a glass of wine while listening to the New York
Philharmonic on the great lawn in Central Park, but if you're a young
person on the beach at Coney Island drinking a beer you can get a tick-
et. This bill won't mean you can drink and drive nor will it allow
people to be disorderly, but will allow people to responsibly and legal-
ly have a drink in certain public places. This will bring consistency
and fairness to our open container laws and help reduce the potential
for discriminatory enforcement.
