  TITLE OF BILL: An act to amend the civil service law, in relation to providing for board of cooperative educational services employees who have been provi- sionally appointed to a position for at least nine months without an exam being offered for such position to receive a permanent appointment in such position   PURPOSE OR GENERAL IDEA OF BILL: This legislation will amend the civil service law to provide that board of cooperative educational service temporary employees who have been provisionally appointed to a position for at least nine months without an exam being offered for such position to receive permanent appointment in such position so as to not force schools to dismiss proficient and dedicated staff.   SUMMARY OF PROVISIONS: Section 1 amends section 65 of the civil service law by adding a new subdivision 5 which allows for provisional employees of a board of coop- erative educational services where no civil service examination has been conducted within nine months of such appointment can be considered on good merit for permanent employment. Section 2 provides that the effective date shall take effect immediate- ly.   JUSTIFICATION: The civil service examinations are only offered every one to four years. This exam is required in order to receive permanent employment with the Board of cooperative educational service (BOCES). BOCES provides essen- tial educational programs and services that increase learning opportu- nities for children in collaboration with New York State school systems. The restricted availability of these tests poses a serious obstacle to temporary workers seeking permanent status, restricting workforce stability and the retention of skilled workers. BOCES provides invalu- able opportunities to students, and their staff plays a key role in the process. By offering permanent appointments to dedicated and proficient employees of BOCES, we can better serve students and our school districts.   PRIOR LEGISLATIVE HISTORY: New Bill   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None.   EFFECTIVE DATE: This act shall take effect immediately.

        AN ACT to amend the civil service law,  in  relation  to  providing  for
          board  of  cooperative  educational  services  employees who have been
          provisionally appointed to a position for at least nine months without
          an exam being  offered  for  such  position  to  receive  a  permanent
          appointment in such position
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 65 of the civil service law is amended by adding  a
     2  new subdivision 5 to read as follows:
     3    5.  Provisional  appointments within boards of cooperative educational
     4  services. Notwithstanding any inconsistent provision of this chapter  or
     5  any  other  law  or  rule  to the contrary, where a board of cooperative
     6  educational services has made a provisional appointment  to  a  position
     7  and  no  civil  service examination for such position has been conducted
     8  within nine months of  such  appointment,  the  provisional  appointment
     9  shall  not  expire under subdivision two of this section and instead the
    10  provisional  appointee  shall  be  considered  to  have  been  appointed
    11  consistent with section sixty-one of this title.
    12    § 2. This act shall take effect immediately.
