  TITLE OF BILL: An act to amend the education law, in relation to prohibiting the use of most artificial intelligence in classrooms prior to high school   PURPOSE OR GENERAL IDEA OF BILL: To ensure educational best practices are followed in New York State by limiting the use of artificial intelligence in classrooms prior to high school   SUMMARY OF PROVISIONS: Section 1 amends the education law by adding a new section with the following provisions: defines artificial intelligence; stipulates that no artificial intelligence (AI) be used in classrooms in schools prior to ninth grade except for diagnostic purposes or instructional inter- ventions for students with disabilities based on guidance from the Commissioner of the State Education Department; and, stipulates that AI can be used for administrative and planning purposes. Section 3 sets the effective date.   JUSTIFICATION: AI should not be introduced into New York State's K- 8 classrooms as a substitute for teacher-based pedagogy without proper vetting and clear evidence as to its impact on student learning achievement and overall intellectual and socio-emotional growth. The goal of progressive education should be to ensure students have strong foundational skills, be critical thinkers, develop the capacity for collaborative work and collective problem solving, and develop social skills that will help them in school and their personal lives. The focus should be in successfully implementing evidence-based prac- tices in our schools not the use of unproven technology.   PRIOR LEGISLATIVE HISTORY: This is a new bill.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: TBD   EFFECTIVE DATE: First of July following the date on which it shall have become a law.

        AN ACT to amend the education law, in relation to prohibiting the use of
          most artificial intelligence in classrooms prior to high school
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. The education law is amended by adding a new section 115 to
     2  read as follows:
     3    § 115. Artificial intelligence prohibited. 1. As used in this section,
     4  the  term  "artificial  intelligence"  or  "AI"  means any machine-based
     5  system that makes decisions based on algorithms,  machine  learning,  or
     6  any form of data-driven modeling.
     7    2.  No  artificial intelligence shall be used in classrooms in schools
     8  prior to ninth grade; provided, however, AI may be used  for  diagnostic
     9  purposes  or  explicit instruction interventions for students with disa-
    10  bilities.  The commissioner shall provide school districts with guidance
    11  regarding permissible uses  and  best  practices  regarding  such  uses.
    12  Nothing in this section shall limit the ability of teachers, administra-
    13  tors,  and other school personnel to use AI for administrative and plan-
    14  ning purposes.
    15    § 2. This act shall take effect on the first of July  next  succeeding
    16  the date on which it shall have become a law. Effective immediately, the
    17  addition,  amendment  and/or  repeal of any rule or regulation necessary
    18  for the implementation of this act on its effective date are  authorized
    19  to be made and completed on or before such effective date.
