  TITLE OF BILL: An act to amend the town law and the public officers law, in relation to authorizing the assistant court clerk and fire marshal of the town of Harrison, county of Westchester, to be nonresidents of such town   PURPOSE OF BILL: To waive the residency requirement for the assistant court clerk and fire marshal in the town of Harrison, county of Westchester   SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends section 23 of the town law by adding subdivision 37 to allow the assistant court clerk and fire marshal of the town of Harrison to reside outside of the town as long as they reside within Westchester County. Section 2 amends section 3 of the public officers law by adding subdivi- sion 76 to allow the assistant court clerk and fire marshal of the town of Harrison to reside outside of the town'as long as they reside within Westchester County. Section 3 sets the effective date.   JUSTIFICATION: This legislation was requested by the town of Harrison. The bill allows the town of Harrison to hire, for the positions of assistant court clerk and fire marshal, anyone who resides in the state of New York, so long as they reside in Westchester County. The town has sought to fill these positions for some time. This bill will expand the pool of eligible candidates and will enable the town to hire the most qualified candi- dates for these positions.   PRIOR LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect immediately.
