AN ACT to amend the general business law, in relation to requiring
information concerning services for human trafficking victims to be
posted in lactation rooms at truck stops
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivisions 1 and 3 of section 390-d of the general busi-
2 ness law, as added by chapter 391 of the laws of 2022, are amended to
3 read as follows:
4 1. The operator of any truck stop shall make available in plain view
5 and in a conspicuous place and manner in all sanitary facilities avail-
6 able for public use and in any lactation rooms, informational cards
7 and/or signs developed by:
8 [(i)] (a) the office of temporary and disability assistance in consul-
9 tation with the New York state interagency task force on human traffick-
10 ing; or
11 [(ii)] (b) the United States Department of Homeland Security.
12 3. For purposes of this section, ["truck] the following terms shall
13 have the following meanings:
14 (a) "Truck stop" shall mean a facility that has the capacity to
15 provide fuel or service, or both, to any commercial motor vehicle as
16 defined by subdivision four of section five hundred one-a of the vehicle
17 and traffic law operating in commerce which is located within twenty-
18 five hundred feet of a controlled-access highway as defined by section
19 one hundred nine of the vehicle and traffic law which has been func-
20 tionally classified by the department of transportation as principal
21 arterial - interstate or principal arterial - other freeway/expressway
22 on official functional classification maps approved by the federal high-
23 way administration pursuant to part 470.105 of title 23 of the code of
24 federal regulations, as amended from time to time.

1 (b) "Lactation room" shall mean a hygienic place, other than a rest-
2 room, that is: (i) is shielded from view; (ii) is free from intrusion;
3 (iii) contains a chair, a working surface, and, if the building is
4 otherwise supplied with electricity, an electrical outlet; and (iv)
5 intended to be used for the primary purpose of breastfeeding or express-
6 ing breast milk.
7 § 2. This act shall take effect on the sixtieth day after it shall
8 have become a law.
