AN ACT to amend the public service law, in relation to decisions regard-
ing the siting of major utility transmission facilities
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 120 of the public service law is amended by adding
2 a new subdivision 6 to read as follows:
3 6. "Public interest" when considering the siting of fuel transmission
4 lines, includes, but is not limited to, the consideration of energy
5 affordability, reliability, and the safety and environmental impact of
6 other methods of transportation, including the transportation of liqui-
7 fied natural gas using commercial vehicles.
8 § 2. Paragraph (h) of subdivision 1 of section 126 of the public
9 service law, as amended by chapter 521 of the laws of 2015, is amended
10 and a new paragraph (i) is added to read as follows:
11 (h) that the facility will serve the public interest, convenience, and
12 necessity, provided, however, that a determination of necessity made by
13 the power authority of the state of New York pursuant to section ten
14 hundred five of the public authorities law for a major utility trans-
15 mission facility for which an application has been filed prior to July
16 first, nineteen hundred seventy-eight pursuant to section one hundred
17 twenty-two of this [chapter] article, shall be conclusive on the commis-
18 sion[.];
19 (i) in the case of a gas transmission line that the alternative method
20 of using commercial vehicles for the purpose of transporting liquified
21 natural gas poses a hazard to public safety.
22 § 3. This act shall take effect immediately.
