AN ACT to amend the executive law, in relation to the timeframe for
implementation of recommendations included within final reports for
corrective action
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 170 of the executive law, as added by chapter 218
2 of the laws of 1977, is amended to read as follows:
3 § 170. Audit of agencies by the state comptroller; reports of correc-
4 tive action. Whenever the state comptroller shall conduct an audit of
5 the activities and operations of any department, bureau, board, commis-
6 sion, authority or any other agency or instrumentality, he or she shall
7 submit a [tenative] tentative copy of a report of such audit to the head
8 of the entity audited. The head of such entity may submit a written
9 response to such tentative report within thirty days of the receipt
10 thereof. The state comptroller shall thereafter submit a final report of
11 such audit which shall contain a complete copy of the response, if any,
12 submitted to the tentative report. If the final report makes recommenda-
13 tions for corrective action, the head of the entity audited shall report
14 within [ninety] one hundred eighty days after receipt thereof to the
15 governor, the state comptroller, the president, president pro tem and
16 minority leader of the senate, the speaker, majority and minority lead-
17 ers of the assembly, and the chairman and ranking minority members of
18 the senate finance committee and the assembly ways and means committees
19 of the state legislature what steps were taken to implement such recom-
20 mendations, and, where recommendations were not implemented, the reasons
21 therefor.
22 § 2. This act shall take effect immediately.
