TITLE OF BILL: An act to amend the labor law and the public officers
law, in relation to public access to certain records regarding public
work and building service employees
PURPOSE OR GENERAL IDEA OF BILL: Amends the public officer law to
require the disclosure of records regarding public work projects. Does
not require the disclosure of anyone's address, social security number
or phone number.
SUMMARY OF SPECIFIC PROVISIONS: Amends Sections 87 and 89 of the Public
Officers Law to require the disclosure of names, rates of wages and
supplements, employee classifications, and number of hours worked by
workers employed on government projects covered by the prevailing wage
law who have been designated by their contractors as apprentices.
JUSTIFICATION: This bill requires the disclosure of taxpayer payments
to people working on a public project receiving government funds. The
State constitution and the NYS Labor Law require the payment of the
prevailing wage to persons employed on these projects. This bill does
NOT require the disclosure of social security numbers, names, addresses
or phone numbers. Somebody working on a government project, whose
employer is required by law to certify his or her rate of pay of taxpay-
er funds, is protected by this legislation. To be classified as an
apprentice on a prevailing wage project that individual must be desig-
nated by their employer as an "apprentice", enrolled in a NYSDOL
approved apprenticeship program and registered with NYSDOL. The regis-
tration list at NYSDOL is FOILable. This bill merely permits verifica-
tion that properly enrolled apprentices have been correctly designated
by their employer on the construction project.

FISCAL IMPLICATIONS: None to the State. These records are required by
law to be kept by public contracting agencies, are provided by public
contractors, and the cost of copying is paid by the entity seeking the
disclosure of the information.
EFFECTIVE DATE: This act shall take effect on the sixtieth day after it
shall have become a law.
