 BILL NUMBER : A2403

 TITLE OF BILL :  An act to amend the general business law, in
relation to prohibiting the wearing of certain apparel by consumers
prior to the purchase thereof


 PURPOSE OR GENERAL IDEA OF BILL:  To protect the public health and
welfare from unsanitary conditions by prohibiting the wearing of
undergarments prior to purchase.

 SUMMARY OF SPECIFIC PROVISIONS:  Section 1. Article 40 and sections
900 and 901 of the general business law are renumbered article 41 and
sections 910 and 911, and a new article 40 is added, which prohibits
mercantile establishments from allowing customers to wear underwear
prior to purchase, and proscribes penalties for violations.

Section 2. Effective Date.

 STATEMENT IN SUPPORT:  This bill is intended to reduce the spread of
infectious disease by prohibiting the potentially dangerous practice
of allowing several persons to wear undergarments prior to purchase.

 FISCAL IMPLICATIONS:  2007-2008:  A.730

 EFFECTIVE DATE:  This act shall take effect on the first day of
November, succeeding the date on which it shall have become law.
