TITLE OF BILL : An act to amend the correction law, in relation to
reimbursing localities for the cost of transporting certain prisoners
to prison
PURPOSE OF BILL :
Localities are currently reimbursed for a portion of the cost incurred
while transporting a prisoner to state prison. This bill would provide
for the reimbursement of localities' actual cost, as determined by the
Director of the State Budget.
SUMMARY OF PROVISIONS :
The bill amends Section 602 of the Correction Law by deleting the
formula by which reimbursement for transporting prisoners to state
prison is reduced, and allowing for reimbursement of localities'
actual cost including the salaries of employees transporting felony
inmates to state prisons. This reimbursement cost would be subject to
the approval of the State Director of the Budget.
REASONS FOR SUPPORT :
New York City and New York State's other 57 Counties are required,
under Section 430.30 of the Criminal Procedure Law, to deliver
convicted felons to state prison. The current reimbursement formula,
under Section 602 of the Correction Law, does not cover the actual
total costs. It is estimated that it cost about $1,500,000 statewide
to transport these inmates, with current reimbursement from the State
being about $600,000. This leaves an approximate $900,000
unreimbursed expense. This in effect is an unfunded mandate, in that
the State mandates New York City and New York State's other 57
Counties to assume an expense for which they are not fully reimbursed.
This bill would rectify current inequity by providing for
reimbursement of the actual cost, as approved by the State Director of
the Budget.
