 TITLE OF BILL :  An act to amend the education law, in relation to
the practice of the professions of engineering and land surveying

 PURPOSE OR GENERAL IDEA OF BILL : To allow corporations which have
engaged in the practice of engineering and land surveying prior to
April 5, 1935 to continue to practice regardless of whether there was
a time period in which such corporation ceased to practice engineering
or land surveying.

 SUMMARY OF SPECIFIC PROVISIONS : Section 1 amends subdivision 6 of
section 7209 of the education law to provide that corporations which
have engaged in the practice of engineering or land surveying before
April 15, 1935 can continue to practice regardless of whether there
was a time period in which such corporation ceased to practice
engineering or land surveying.

Section 2 provides for this act to take effect immediately

 JUSTIFICATION : Under current law, in order for an engineering or
land surveying corporation to engage in the practice of engineering or
land surveying, there are three prerequisites: 1. the corporation had
practiced these professions prior to 1935; 2. the corporation had been
continuously headed by a licensed professional engineer (for an
engineering firm) or a licensed land surveyor (for a land surveying
firm); and 3. the corporation has continuously provided professional
engineering or land surveying services.

If such corporation was providing both services prior to 1935 but
temporarily suspended one of the practices, the State Education
Department has held that subdivision 6 of section 7209 prevents such
corporations from resuming such practice. This bill will allow these
corporations to resume such services.
