  TITLE OF BILL: An act to amend the tax law, in relation to extending the authorization granted to the county of Franklin to impose an additional one percent of sales and compensating use taxes   PURPOSE: To extend Franklin County's authorization for its additional sales and compensating tax for an additional two years.   SUMMARY OF PROVISIONS: Section 1- Amends clause 40 of subparagraph (i) of the opening paragraph of section 1210 of the tax law authorizing Franklin County to extend its additional one-percent sales and compensating tax until Nov. 30, 2025. Section 2 - Provides effective date   JUSTIFICATION: For years, Franklin County has implemented an additional one-percent sales tax to continue to adequately fund the necessary programs and operations of the county government. New York State has previously granted Franklin County the authority for this sales tax increase that is set to expire on December 1, 2023. On Feb. 2, 2023, the Franklin County board voted unanimously to approve a resolution seeking legis- lation that would extend its authority to impose an additional one-per- cent sales tax which is necessary for them to continue their operations.   LEGISLATIVE HISTORY: New Bill   FISCAL IMPLICATIONS: None to the state   EFFECTIVE DATE:

        AN  ACT to amend the tax law, in relation to extending the authorization
          granted to the county of Franklin to impose an additional one  percent
          of sales and compensating use taxes
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Clause 40 of subparagraph (i) of the opening  paragraph  of
     2  section  1210  of  the  tax  law,  as  amended by section 1 of item P of
     3  subpart C of part XXX of chapter 58 of the laws of 2020, is  amended  to
     4  read as follows:
     5    (40) the county of Franklin is hereby further authorized and empowered
     6  to  adopt  and amend local laws, ordinances or resolutions imposing such
     7  taxes at a rate that is one percent additional to the three percent rate
     8  authorized above in this paragraph for such county for the period begin-
     9  ning June first, two thousand six and  ending  November  thirtieth,  two
    10  thousand [twenty-three] twenty-five;
    11    § 2. This act shall take effect immediately.
