TITLE OF BILL: An act to amend the penal law, in relation to persistent
sexual abuse
PURPOSE OR GENERAL IDEA OF BILL: Includes all sex crimes contained in
penal law section 130.00 to the list of eligible crimes for persistent
sexual abuse.
SUMMARY OF SPECIFIC PROVISIONS: This bill amends section 130.53 of the
penal law to include all sex offense crimes enumerated in penal law
section 130.00 to the list of eligible crimes for persistent sexual
abuse.
JUSTIFICATION: Persistent sexual abuse should be expanded to include
any crime contained in Penal Law section 130.00. Currently, a defendant
can be predicated on a crime of Sexual Abuse in the third degree, which
is only a class B misdemeanor. A defendant who is convicted of the
crimes of rape or sodomy should certainly be predicated for committing a
more heinous and egregious crime.
