  TITLE OF BILL: An act to amend the general municipal law, in relation to establishing an administrative adjudication hearing procedure for code and ordinance violations for the city of Long Beach   PURPOSE: To authorize the City of Long Beach to establish an administrative adju- dication hearing procedure for code and ordinance violations and traffic infractions.   SUMMARY OF PROVISIONS: Section 1: Adds a new subdivision to Section 380 of the General Munici- pal Law, authorizing the City of Long Beach to adopt a local law to establish an administrative adjudication hearing procedure for code and ordinance violations relating to conditions which constitute a threat or danger to the public health, safety or welfare. Further provides that such administrative adjudication bureau may also provide for the hearing and determination of traffic infractions constituting parking, standing, or stopping violations. Section 2: Provides the effective date.   JUSTIFICATION: This legislation has been requested by the City of Long Beach, and would allow the city to establish an administrative adjudication hearing procedure for code and ordinance violations, as well as for traffic infractions, thereby streamlining the process for resolving these violations and infractions.   LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS: None to the state.   EFFECTIVE DATE: This act shall take effect immediately.

        AN  ACT  to amend the general municipal law, in relation to establishing
          an administrative adjudication hearing procedure for  code  and  ordi-
          nance violations for the city of Long Beach

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 380 of the general  municipal  law  is  amended  by
     2  adding a new subdivision 7 to read as follows:
     3    7. The city of Long Beach may adopt a local law establishing an admin-
     4  istrative  adjudication  hearing  procedure under the provisions of this
     5  article for all code and ordinance  violations  relating  to  conditions
     6  which  constitute  a  threat  or  danger to the public health, safety or
     7  welfare provided, however, that such administrative adjudication hearing
     8  procedure shall not apply to violations of the building code of the city
     9  of Long  Beach.  Such  administrative  adjudication  bureau  established
    10  pursuant to this subdivision may also provide for the hearing and deter-
    11  mination  of traffic infractions constituting parking, standing or stop-
    12  ping violations, provided that the provisions of article  two-B  of  the
    13  vehicle and traffic law shall apply to such hearing and determinations.
    14    § 2. This act shall take effect immediately.
