TITLE OF BILL: An act to amend the vehicle and traffic law, in
relation to the regulation of idling by local authorities and school
districts
PURPOSE OR GENERAL IDEA OF BILL: This bill authorizes the regulation
of vehicle idling by school districts and local authorities.
SUMMARY OF PROVISIONS: Bill S1 amends subdivision 1 of S1670 of the
Vehicle & Traffic Law, which currently allows school districts and
local authorities to regulate stopping standing and parking with
respect to driveways and parking areas accessory to any school,
playground, park, building or facility under their jurisdiction. The
amendments would add "idling" of vehicles to the list of activities
that can be so regulated.
EFFECTS OF PRESENT LAW WHICH THIS BILL WOULD ALTER: There is
currently no provision for regulation of idling by school districts or
local authorities.
JUSTIFICATION: Emissions from school buses and other motor vehicles
can exacerbate respiratory problems and contribute to asthma and other
health problems for children. Children are particularly vulnerable to
air pollution because, compared to adults, they breathe at a faster
rate and inhale a greater volume of air per pound of body weight.
Idling vehicles produce higher levels of air contaminants than emitted
during driving.
In recognition of these facts, school districts in New York State have
begun to adopt policies creating "no-idling" zones in areas where
children congregate. This bill will provide the legal underpinning to
allow school districts and other local operators of facilities like
parks and playgrounds to establish effective idle-free areas.
