TITLE  OF BILL:  An act in relation to granting Louis P. Mannino certain
credit in the New York state teachers' retirement system

PURPOSE:   To grant Louis Mannino  the  opportunity  to  apply  for  and
receive  service  credit  from  the  New York State Teacher's Retirement
System for the period October 4, 2006 through June 30, 2007

SUMMARY OF PROVISIONS:  This bill would allow Louis  Mannino  a  regular
retirement  benefit  without early retirement reduction if, on or before
the 31st of December 2009, he files a written request therefore with the
head of the New York State teachers' retirement system, Eastern  Suffolk
Boces pays the sum of $61,000.

JUSTIFICATION:    Mr. Mannino was employed by the Eastern Suffolk BOCES.
In the fall of 2006 he was led to believe that if  he  took  termination
leave  for  a  period of 8 months from October to June he would be given
service credit for that leave and would thus have 30 years  of  service.
In  reliance  thereon, Mr. Mannion filed for termination leave, was paid
on a periodic basis just as he had been paid his salary and subsequently
filed for retirement, at which time he was informed that the termination
leave would not be considered creditable service.  This bill would allow
Mr. Mannino to file for retirement without an early retirement reduction
and all additional costs, estimated at $61,000 would be borne by Eastern
Suffolk BOCES.

EFFECTIVE DATE:  This act shall take effect immediately.
