TITLE OF BILL:
An act
to amend the highway law, in relation to state highways in the village
of Medina, Orleans county
PURPOSE: The bill will exchange ownership and
maintenance
responsibility between the village of Medina and the State of New York
regarding roads in such village.
SUMMARY OF SPECIFIC PROVISIONS: Section 1-
Subdivision of 35 of
section 341 of the highway law is amended by adding two new
paragraphs 3 and 4.
Paragraph 3- authorizes and directs the commissioner to assume
jurisdiction for state highway purposes over the village roads
described as follows: the portion of newly rerouted 63,reserved as
state highway nine thousand five hundred sixty two known as North
Main St, from the intersection of Glenwood avenue northerly to West
avenue, and the portion of newly routed sixty-three, as reserved as
state highway nine thousand five hundred sixty-two, known as
Commercial street, from the intersection of West avenue northerly to
Prospect avenue. Issue official orders of abandonment of those
portions of highways described as follows: the portion of state
highway five thousand three hundred fifteen previously routed NY
sixty-three known as Prospect Avenue from West Center street
northerly to Commercial Street,
Paragraph 4- upon the filing of certified copies of such official
order with the village clerk, superintendent of public works, county
clerk, county treasurer, the clerk of the legislative body, county
superintendent of highways, and state comptroller the state shall
cease to maintain the aforesaid highways specified for abandonment as
set forth in paragraph three of this subdivision an all the rights
and obligations of the state shall be turned over and surrendered to
the village of Medina and said state highway shall thereafter be
maintained by the village of Medina as part of the village road system.
JUSTIFICATION: During the course of a recently
completed pass-thru
road reconstruction project, it was determined by both the NYS
Department of Transportation (NYSDOT) and the Village of Medina that
it would be best to reroute State Route 63 in the village to improve
traffic patterns
and reduce the unwanted side effects of heavy truck in residential
neighborhoods, such as noise, pollution and wear and tear on road
surfaces.
This legislation is necessary to finalize the jurisdictional transfer
and maintenance responsibilities of certain sections of roadways
between the NYSDOT and the village of Medina, which has already been
mutually agreed to.
PRIOR LEGISLATIVE HISTORY: None
FISCAL IMPLICATIONS: None- The NYSDOT is transferring
to the Village
of Medina slightly more mileage than it will receive in exchange. The
jurisdiction transfer will remove a net .48 lane miles from the
NYSDOT'S highway inventory.
