TITLE OF BILL:
An act to amend the general business law, in relation to requiring elec-
tric vehicle charging stations to be installed at gasoline stations in
an amount equal to or greater than the number of new gas dispensing
motor fuel pumps being installed
 
PURPOSE:
To require upgrades or expansions of gasoline pumps at gasoline stations
have a matching number of charging stations built as part of the expan-
sion.
 
SUMMARY OF PROVISIONS:
Section 1: The general business law is amended by adding a new section
396-xx; this new section includes definitions of gasoline station, deal-
er, and electric vehicle charging station.
Sets a minimum charge load for an electric vehicle charging station;
requires the installation of electric vehicle charging stations if a
dealer of gasoline decides to install new operational gas dispensing
motor fuel pumps; denies the issuance of building permits to a dealer of
gasoline if the documents submitted to obtain a building permit-do not
reflect, at a minimum, a 1:1 gas pump/electric charging station ratio.
Section 2: Effective Date.
 
JUSTIFICATION:
The state of New York passed the Climate Leadership and Community
Protection Act (CLCPA) in 2019 to address threats and risks posed by
global climate change sustainably and equitably. Central to the state's
strategy to meet the goals codified in the CLCPA is building and invest-
ing in electric vehicles and a robust electric vehicle infrastructure.
This legislation addresses the need to build within the state an elec-
tric vehicle charging station infrastructure to support projected demand
for electric vehicles and to help the state decrease its greenhouse gas
emissions.

AN ACT to amend the general business law, in relation to requiring elec-
tric vehicle charging stations to be installed at gasoline stations in
an amount equal to or greater than the number of new gas dispensing
motor fuel pumps being installed
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The general business law is amended by adding a new
2 section 396-xx to read as follows:
3 § 396-xx. Gasoline station; dealer; electric vehicle charging station
4 required. 1. Definitions. As used in this section:
5 (a) "gasoline station" shall mean a premises or facility greater than
6 fifteen hundred square feet with operational gas dispensing motor fuel
7 pumps that dispense motor fuel available for general public retail sale.
8 (b) "dealer" shall mean any person owning or operating a premises or
9 facility with one or more operational gas dispensing motor fuel pumps
10 that dispense motor fuel available for general public retail sale.
11 (c) "electric vehicle charging station" shall mean a level two charg-
12 ing station that delivers electricity from a source outside an electric
13 vehicle into one or more electric vehicles. An electric vehicle charging
14 station may include several charge points simultaneously connecting
15 several electric vehicles to the station and any related equipment need-
16 ed to facilitate charging plug-in electric vehicles. Each electric
17 vehicle charging station shall have the ability to deliver a charge load
18 of no less than 6kW per station and each electric vehicle charging
19 station shall have non-proprietary chargers capable of charging electric
20 vehicles from at least three different incorporated auto manufacturers.

1 2. Any dealer installing new operational gas dispensing motor fuel
2 pumps for the retail sale of motor fuels for use in motor vehicles shall
3 install electric vehicle charging stations at such gasoline station in
4 an amount equal to or greater than the number of new operational gas
5 dispensing motor fuel pumps being installed at such gasoline station.
6 3. No building permit shall be issued to a dealer if the documentation
7 submitted for such building permit does not reflect the installation of
8 electric vehicle charging stations in an amount equal to or greater than
9 the number of new operational gas dispensing motor fuel pumps being
10 installed at such gasoline station.
11 § 2. This act shall take effect immediately.
