       Introduced  by  Sens.  C. JOHNSON, ADAMS, DIAZ, DUANE, KRUEGER, ONORATO,
         PARKER, THOMPSON -- read twice and ordered printed, and  when  printed
         to  be  committed  to  the  Committee on Investigations and Government
         Operations -- reported favorably from said committee, ordered to first
         and second report, ordered to a third  reading,  amended  and  ordered
         reprinted, retaining its place in the order of third reading -- passed
         by  Senate and delivered to the Assembly, recalled, vote reconsidered,
         restored to third reading, amended and  ordered  reprinted,  retaining
         its place in the order of third reading

       AN  ACT to amend the executive law, in relation to prohibiting employers
         from discriminating against victims of domestic violence  or  stalking
         based upon status as a domestic violence victim

         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:

    1    Section 1. Paragraph (a) of subdivision 1 of section 296 of the execu-
    2  tive law, as amended by chapter 75 of the laws of 2005,  is  amended  to
    3  read as follows:
    4    (a)  For an employer or licensing agency, because of [the] AN INDIVID-
    5  UAL'S age, race, creed,  color,  national  origin,  sexual  orientation,
    6  military  status, sex, disability, predisposing genetic characteristics,
    7  [or] marital status [of any individual],  OR  DOMESTIC  VIOLENCE  VICTIM
    8  STATUS,  to  refuse  to  hire  or  employ or to bar or to discharge from
    9  employment such individual or to discriminate against such individual in
   10  compensation or in terms, conditions or privileges of employment.
   11    S 2. Section 292 of the executive law  is  amended  by  adding  a  new
   12  subdivision 34 to read as follows:
   13    34.  THE  TERM  "DOMESTIC VIOLENCE VICTIM", WHEN USED IN THIS ARTICLE,
   14  MEANS AN INDIVIDUAL WHO IS A VICTIM OF AN ACT WHICH WOULD  CONSTITUTE  A
   15  FAMILY  OFFENSE  PURSUANT  TO  SUBDIVISION  ONE OF SECTION EIGHT HUNDRED
   16  TWELVE OF THE FAMILY COURT ACT.
   17    S 3. This act shall take effect immediately.
