         when printed to be committed to the Committee on Judiciary

       AN ACT to amend the uniform  justice  court  act,  in  relation  to  the
         location  of  holding  town  court  proceedings  of the towns of Elba,
         Oakfield and Batavia

         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:

    1    Section  1. Section 106 of the uniform justice court act is amended by
    2  adding a new subdivision 10 to read as follows:
    3    10. NOTWITHSTANDING THE PROVISIONS OF SUBDIVISION ONE OF THIS SECTION,
    4  THE TOWNS OF ELBA, OAKFIELD AND BATAVIA, IN THE COUNTY OF  GENESEE,  MAY
    5  HOLD ALL TOWN COURT PROCEEDINGS IN ANY OF THE TOWNS OF ELBA, OAKFIELD OR
    6  BATAVIA,  OR  IN THE CITY OF BATAVIA, PROVIDED THAT SUCH PROCEEDINGS ARE
    7  HELD IN A COURTROOM OR OTHER SUITABLE FACILITY OPEN TO  THE  PUBLIC  AND
    8  THE  TOWN  BOARDS  OF  ELBA,  OAKFIELD  AND BATAVIA HAVE AUTHORIZED SUCH
    9  EXTRATERRITORIAL PROCEEDINGS.
   10    S 2. This act shall take effect immediately.
