         ment Operations

       AN ACT to amend the Indian law, in relation to clarifying  that  Tribal-
         State  compacts  which authorize commercialized casino gambling activ-
         ities require legislative authority and express consent

         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:

    1    Section  1.  The  Indian  law is amended by adding a new section 16 to
    2  read as follows:
    3    S 16. GAMING COMPACTS REQUIRE EXPRESS LEGISLATIVE  CONSENT.  NEW  YORK
    4  STATE  SHALL  NOT  ENTER  INTO  ANY  COMPACT  WITH AN INDIAN TRIBE WHICH
    5  AUTHORIZES COMMERCIALIZED CASINO GAMBLING ACTIVITIES UNLESS THAT PARTIC-
    6  ULAR COMPACT IS MADE UNDER THE AUTHORITY, AND WITH THE EXPRESS  CONSENT,
    7  BY STATUTE OR RESOLUTION, OF THE LEGISLATURE.
    8    S 2. This act shall take effect immediately.
