TITLE OF BILL :
An act to amend the education law, in relation to authorizing school
districts to utilize funding subject to contract for excellence
requirements in subsequent school years
PURPOSE OF BILL :
This bill allows a school district, required to submit a contract for
excellence, that is unable to use a portion of the funds dedicated to
the district because the contract for excellence was not approved by
the commissioner of education until after the start of the school
year, to utilize those contract for excellence funds during the next
two succeeding school years.
SUMMARY OF PROVISIONS :
Section 1 - Amends paragraph a of subdivision 2 of section 211-d of
the education law by adding a new subparagraph (vii) which allows,
beginning with the 2007 - 2008 school year, a school district required
to submit a contract for excellence, that is unable to use a portion
of the funds dedicated to the district because the contract for
excellence was not approved by the commissioner of education until
after the start of the school year, to utilize those contract for
excellence funds during the next two succeeding school years.
Section 2 - Enacting clause.
JUSTIFICATION :
School districts were advised that contract for excellence plans were
not to be implemented until final approval for those plans was issued
by the commissioner of education. In some instances that approval did
not come until well after the start of the 2007 - 2008 school year.
School districts that followed the advice of the department of
education delayed starting programs and hiring staff until the
contract for excellence plans were approved.
Under current law school districts cannot carryover any unspent
contract for excellence funding into the following school year.
Therefore, delayed approval of the plans resulted in unspent money
that cannot be carried over to support existing programs.
