TITLE OF BILL:  An act to amend the penal law, in relation to imposing
longer terms of imprisonment upon second sex offenders and persistent
sex offenders

PURPOSE OR GENERAL IDEA OF BILL:
This legislation will triple the minimum and a maximum sentences for
repeat sexual offenders. prosecutors are not utilizing existing laws
to keep sexual predators off our streets because they choose to seek
plea bargains and reduce charges. This bill thereby reduces the
incentives of district attorneys to plead down the sentences of these
predators and ensures that they remain incarcerated in jail for a
extensive period of time.

SUMMARY OF SPECIFIC PROVISIONS:

Section 1 of the bill amends subdivision 3 of section 70.04 of the
penal law.

Section 2 of the bill amends subdivision 3 of section 70.04 of the
penal law.

Section 3 of the bill amends subdivision 3 of section 70.04 of the
penal law.

Section 4 of the bill amends subdivision 3 of section 70.06 of the
penal law.

Section 5 of the bill amends subdivision 6 of section 70.06 of the
penal law.

Section 6 of the bill amends subdivision 3 of section 70.04 of the
penal law.

Section 7 of the bill amends subdivision 3 of section 70.08 of the
penal law.

Section 8 of the bill amends subdivision 2 of section 70.10 of the
penal law.

JUSTIFICATION:
Sexual predators must remain in our correctional facilities longer.
The plea bargaining practices of District Attorneys must end.
District Attorneys plead down the cases of the most heinous crimes to
pad their conviction records. Sexual predators are being released
after short sentences not commensurate with their crime. If we can
double the penalties for speeding in work zones, we can triple the
penalties for those that rape and kill our women and children.

EFFECTIVE DATE:


This act shall take effect on the first of November next succeeding
the date on which it shall have become a law.
