        AN ACT to amend the public health law, in relation to continuing medical
          education on pain management, palliative care and addiction
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. The opening paragraph of subdivision 3 of section 3309-a of
     2  the  public health law, as added by a chapter of the laws of 2015 amend-
     3  ing the public health law relating to the prescription  pain  medication
     4  awareness  program,  as proposed in legislative bills numbers S.4348 and
     5  A.355, is amended to read as follows:
     6    The commissioner, in consultation with the commissioner of  education,
     7  shall establish standards, and review and implement requirements for the
     8  performance  of continuing medical education on pain management, pallia-
     9  tive care and addiction.    Every  health  care  professional  licensed,
    10  registered  or certified under title eight of the education law to treat
    11  humans and registered under the federal controlled substances act and in
    12  possession of a registration number from the drug  enforcement  adminis-
    13  tration,  United  States Department of Justice, or its successor agency,
    14  shall, [every two years] prior to renewal of registration  to  practice,
    15  complete  three  hours  of  course  work  as  set forth in this section;
    16  provided, however, that said hours shall be deemed to count  toward  the
    17  professional's obligation for board certification or existing continuing
    18  education requirement for licensure.
    19    §  2.  This  act  shall  take  effect on the same date and in the same
    20  manner as a chapter of the laws of 2015 amending the public  health  law
    21  relating  to  the  prescription  pain  medication  awareness program, as
    22  proposed in legislative bills numbers S.4348 and  A.355,  takes  effect,
    23  provided  that  the amendments to subdivision 3 of section 3309-a of the
    24  public health law, made by section one of this act, shall not affect the
    25  expiration and repeal of such  subdivision,  and  shall  expire  and  be
    26  deemed repealed therewith.
