A00988 Memo:

NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A988

SPONSOR: Rosenthal L
TITLE OF BILL: An act to repeal section 1 of a chapter of the laws of 2022 relating to determining whether the state can claim federal financial participation for coverage of and payment for certain prescription digital therapeu- tics, as proposed in legislative bills numbers S. 559 and A. 3642, in relation to prescription digital therapeutics   PURPOSE: To ensure the law reflects a proper description of how prescription digital therapeutics are utilized.   SUMMARY OF PROVISIONS: This bill amends chapter 824 of the laws of 2022 by removing section 1 of the chapter relating to the legislative intent of the chapter.   JUSTIFICATION: Prescription digital therapeutics are innovative software-based thera- peutic interventions which have demonstrated clinical benefits to New Yorkers who are recovering from substance and opioid use disorders as well as in treatment for mental health conditions. Especially over the COVID-19 pandemic where in-person health care was restricted and normal- ly scheduled treatment may have been delayed, these highly engaging digital applications acted as an ancillary arm for health care providers to prevent, manage, or treat a medical disorder or disease. This legis- lation amends chapter 824 of the laws of 2022, which seeks Medicaid coverage of prescription digital therapeutics, to remove unnecessary legislative intent language.   LEGISLATIVE HISTORY: This is a new bill.   BUDGET IMPLICATIONS: Potential Medicaid savings.   EFFECTIVE DATE: This act shall take effect on the same date and in the same manner as a chapter of the laws of 2022 relating to determining whether the state can claim federal financial participation for coverage of and payment for certain prescription digital therapeutics, as proposed in legisla- tive bills numbers S.559 and A.3642, takes effect.
