TITLE OF BILL:
An act to amend the education law, in relation to the provision of
certain programs and services to private or parochial school or home-in-
structed pupils
 
PURPOSE OR GENERAL IDEA OF BILL:
To allow private or parochial school or home-instructed pupils to
participate in inter-school, intramural and extramural athletics, and
other extracurricular activities with the consent of the board of educa-
tion.
 
SUMMARY OF SPECIFIC PROVISIONS:
This bill adds a new Education Law section 3204a to provide that local
school districts, except any school districts located in cities having a
population of one million or more, shall allow private or parochial
school or hone-instructed children to participate in extracurricular
activities and school athletic programs, upon a written request, to the
board of education which is filed prior to June first each year.
 
JUSTIFICATION:
Presently, private or parochial school pupils may participate in extra-
curricular activities and intramural & extramural sports at the
discretion of the local beard of education, are precluded from partic-
ipating in interscholastic sports by regulation. However, their fami-
lies pay real property taxes to financially support such local school
district. This legislation would afford parents of private or parochial
students the ability to bring this decision to the attention of the
school bard and provide home instructed pupils with the opportunity to
participate in the same after-school activities that are granted to all
public school pupils.

AN ACT to amend the education law, in relation to the provision of
certain programs and services to private or parochial school or home-
instructed pupils
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The education law is amended by adding a new section 3204-a
2 to read as follows:
3 § 3204-a. Provision of certain programs and services to private or
4 parochial school or home-instructed pupils. 1. As used in this section,
5 the term "programs and services" shall mean participation in all extra-
6 curricular activities, and intraschool, intramural, and extramural
7 athletics pursuant to regulations promulgated by the commissioner.
8 2. The school authorities of any school district and any community
9 school district in the state, except any school districts located in
10 cities having a population of one million or more shall furnish programs
11 and services to pupils who are residents of this state and who attend
12 private or parochial schools or who are instructed at home in such
13 school districts, upon the written request of the persons in parental
14 relation to any such pupil. Such a request shall be filed with the board
15 of education of the school district in which the persons in parental
16 relation to any such pupil reside on or before the first day of June
17 preceding the school year for which the request is made.
18 § 2. This act shall take effect on the first of July next succeeding
19 the date on which it shall have become a law.
